Terms of Service

1. About Musteer
Musteer is a group trip planning tool operated by Alexander James (sole trader) trading as Musteer, with a correspondence address at The Glas, Pontcanna, CF11 9PF (“we”, “us”, “our”). By creating an account or using the service you agree to these Terms of Service. If you do not agree, please do not use Musteer.
2. Eligibility
You must be at least 18 years old to create a Musteer organiser account. By signing up you confirm that you meet this requirement.
3. Organiser Accounts
When you create an account you are responsible for keeping your login credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at musteer.app@gmail.com if you believe your account has been compromised. We reserve the right to suspend accounts where we have reasonable grounds to believe security has been breached.
4. Free Tier and Pro Subscription
Musteer offers a free tier and a paid Pro subscription. Feature availability across tiers is as described on our pricing page. We reserve the right to adjust tier limits on 30 days' notice to existing users.
By subscribing to Pro you authorise us to charge your payment method on a recurring monthly or annual basis at the price shown at checkout. Subscriptions renew automatically unless cancelled before the renewal date. You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain Pro access until then.
Prices may change on 30 days' notice to existing subscribers. Continued use after a price change constitutes acceptance of the updated price.
Payments are processed by Stripe, Inc. We do not store your card details. For billing queries contact musteer.app@gmail.com.
5. Your Right to Cancel and Refund Policy
Under the Consumer Contracts Regulations 2013 you have a statutory 14-day right to cancel a new Pro subscription. By ticking the acknowledgement box at checkout and accessing Pro features immediately, you expressly request early performance of the contract and acknowledge that your right to cancel without charge will be lost once the service has been fully performed or used during that window.
If you do not waive this right, you may cancel within 14 days of subscribing for a full refund by emailing musteer.app@gmail.com with the subject line “Cancellation request”.
For monthly subscriptions: no refund is issued for the current billing period once access has been granted, unless the 14-day right above applies.
For annual subscriptions: a pro-rata refund for unused complete months may be issued at our reasonable discretion.
If the service is materially unavailable for more than 48 consecutive hours we will issue a pro-rata service credit for the affected period on request.
Nothing in this section affects your statutory rights as a consumer under applicable UK law.
6. Acceptable Use
You agree not to use Musteer to:
- Violate any applicable law or regulation.
- Send unsolicited commercial communications to survey respondents.
- Collect personal data from respondents beyond what is needed for trip planning.
- Use respondent data for any purpose other than organising the trip for which it was collected.
- Attempt to reverse-engineer, scrape, or disrupt the service.
- Impersonate any person or organisation.
- Upload or transmit any content that is unlawful, harmful, defamatory, or infringes third-party rights.
7. Survey Respondents
Survey respondents are third parties who complete a survey shared by an organiser. Respondents submit their answers voluntarily after accepting a consent notice presented by Musteer. Organisers are responsible for ensuring they have a lawful basis to collect and use respondent data, and for using that data in compliance with applicable data protection law including UK GDPR.
8. Data Responsibilities
As an organiser you are the data controller for personal data you collect from your trip participants via Musteer surveys. Musteer processes participant data on your behalf as a data processor, as described in our Privacy Notice. You are responsible for ensuring your use of respondent data complies with all applicable data protection legislation.
9. Payments Between Organisers and Participants
Musteer does not process or facilitate payments between organisers and trip participants. Payment status fields in the app are for the organiser's record-keeping only. We are not a payment service provider and accept no liability for financial disputes between organisers and participants. For Musteer subscription billing, see Section 4.
10. AI-Generated Content
Musteer uses artificial intelligence to generate trip planning suggestions, summaries, and other content. AI-generated content is provided for convenience only and may be inaccurate, incomplete, or out of date. You are responsible for verifying all AI-generated suggestions before acting on them. We accept no liability for decisions made in reliance on AI-generated content.
11. Intellectual Property
Musteer and its original content, features, and functionality are owned by us and are protected by copyright and other applicable intellectual property laws. You retain ownership of any trip content you create. You grant us a limited, non-exclusive, royalty-free licence to store, process, and display your content solely to provide the service to you.
12. Disclaimers
The service is provided “as is” without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose or uninterrupted availability. We do not guarantee that the service will be available uninterrupted or error-free. We are not responsible for the accuracy of trip details entered by organisers.
13. Limitation of Liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited. If you are a consumer, your statutory rights under the Consumer Rights Act 2015 and other applicable legislation are not affected.
Subject to the above, to the fullest extent permitted by law, our total liability to you arising out of or in connection with these terms or the service shall not exceed the greater of: (a) the total amount you paid us in the 12 months immediately preceding the event giving rise to the claim, or (b) £100.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, even if we have been advised of the possibility of such damages.
14. Force Majeure
We are not liable for any failure or delay in performance of our obligations caused by circumstances beyond our reasonable control, including but not limited to internet outages, third-party service failures, or acts of God.
15. Beta and Early Access
During any beta or early access period, features may be incomplete, subject to change without notice, or withdrawn. Beta access is provided without warranty and does not constitute a commitment to any specific feature set or level of service.
16. Termination
We may suspend or terminate your account if you breach these terms or if we reasonably believe your use of the service poses a risk to other users or the integrity of the platform. We will give you notice where reasonably practicable. You may close your account at any time from your profile settings or by emailing musteer.app@gmail.com. On termination, your trip and survey data will be handled in accordance with our Privacy Notice.
17. Dispute Resolution
We will attempt to resolve any disputes informally in the first instance — please contact us at musteer.app@gmail.com and allow 14 days for a response. If we cannot resolve a dispute informally, you may refer it to an approved Alternative Dispute Resolution provider; details available on request.
18. Governing Law
These terms are governed by the laws of England and Wales. Any disputes not resolved through the process in Section 17 shall be subject to the exclusive jurisdiction of the courts of England and Wales.
19. Changes to These Terms
We may update these terms from time to time. Material changes will be communicated to organiser accounts by email at least 14 days before taking effect. Continued use of the service after that date constitutes acceptance of the updated terms. The “last updated” date at the top of this page always reflects the current version.
